The law has to be created from a baseline. That baseline is the Constitution. Therefore, when a president establishes an executive order, congress enacts legislation, or a lower court makes a ruling they all need to be in line with the constitution. Only the Supreme Court has the power to change the interpretation of constitutional statutes. Therefore, when the con in this debate keeps trying to sidestep the questions regarding the constitutionality of the travel ban they are directly sidestepping the fundamental question of lawfulness because the only way to determine if a statute is lawful is to determine how that law exists in regards to constitutional interpretation.
